Terms of Use & Return Policy
Stockpile USA (“Stockpile”) welcomes communication from customers about their purchase or prospective purchase. Most inquiries during business hours, Monday through Friday, are answered within two hours.
Use of Stockpile USA’s eBay store constitutes an agreement by the customer to be bound by these Terms of Use and Return Policy as a legally enforceable contract.
NO WARRANTY
Products are sold AS IS WITH NO WARRANTY unless specifically noted by us. Ebay offers SquareTrade® protection; HOWEVER, this is NOT offered through Stockpile, and will not be honored as a warranty by the product manufacturer.
RETURNS
A representative is available for troubleshooting any product issues you may have over the phone or via email, Monday through Friday during regular business hours. Most issues are easily resolved over the phone.
All sales are final. NO RETURNS ARE ACCEPTED BY STOCKPILE, unless there is a defect in the product. Please contact Stockpile if you feel you received a defective product.
FORCE MAJEURE/IMPOSSIBILITY/COMMERCIAL IMPRACTICABILITY
We make every effort to ship the product ordered by the customer in a timely manner. However, on rare occasions, a product may become unavailable after it has been ordered by the customer. We will refund the purchase price in full in the event the product is not available, or if we cannot locate a suitable replacement in a timely manner.
A customer will not leave negative feedback
in regards to any transactions with us that have become frustrated for reasons including but not limited to the following:
The product is no longer available though it was believed to be at the time of the product’s purchase by the customer;
Shipping is delayed due to issues with the product supply chain, shipping company delays, or any other reason out of our control;
In the occurrence of acts of war, earthquake, civil uprising, pandemic, acts of God, acts of terrorism, extreme weather, governmental shutdown, supply line interruption, among other things completely out of our control, that create an impossibility for us to provide the product in a timely manner or at all, or the transaction is rendered commercially impracticable.
Negative feedback left when situations relating to the above are present is considered breach of contract for the purposes of the Terms of Use and Return Policy.
TORTIOUS INTERFERENCE OF PROSPECTIVE BUSINESS RELATIONS & DEFAMATION
In the event of an issue with a product or the sales process, a customer is required to engage in good faith efforts with us to resolve the problem
prior
to
leaving negative feedback or disputing a charge through their credit card or bank.
Negative feedback can be extremely damaging to our future business dealings and constitutes tortious interference of prospective business relations and/or defamation. Should a customer refuse to engage in good faith discussions with one of our representatives, that customer will have 72 hours from the date/time that we become aware of the tortious behavior to remove negative feedback. After 72 hours have passed, we may pursue legal action to enforce our Terms of Use and Return Policy. The customer is liable to pay for any costs associated with enforcing the Terms of Use and Return Policy, including mailing, filing, service of process, and other court costs and attorney’s fees.
Because a full determination of the damages caused by the tortious behavior may be difficult to ascertain, the customer will be subjected to liability for liquidated damages in an amount no less than ,000.00 per incident in legal proceedings to enforce the Terms of Use and Return Policy.
CHOICE OF LAW & JURISDICTION
Disputes arising from a customer’s use of our eBay store and to enforce these Terms of Service and Return Policy are subject to the laws of the state of Utah. Any enforcement action will be filed in any appropriate court within the state of Utah, to include small claims courts that may be convenient to us. Customers who engage in business with us submit to the personal jurisdiction of the courts of and within the state of Utah.
